Compliance in France – better understanding on how it works – analysis on risks and opportunities for Groups who have a local entity in France
- Are you a foreign company based in France (or with a subsidiary based in France)?
- Are you a foreign shareholder?
- Does France appear to you as an “atypical” country in terms of compliance and ethics regulation?
Risk and Compliance Institute (IRC) is there to help you better understand the regulatory, judicial and stakeholder system. This will be an opportunity to meet experts on white collar crime, Sapin 2 Law, vigilance, non-financial reporting, ESG etc
Part 1 – Regulations and their risks
In this session, Gilles Sabart will answer to the following questions :
What do the French and Anglo-Saxon system have in common?
Environmental Ethic – Vigilance / ESG CSR-D: how to explain the system?
Business Ethics – Ethical lobbying : how far can we go ?
Ethics at Work: How can we talk about whistleblowers and internal investigations?
Part 2 – How the French anti-corruption laws have changed and practical tips on how to manage multi-jurisdictionnal investigations
Since the enactment of France’s anti-corruption law, Sapin II in June 2017, which was considered groundbreaking, the French enforcement authority (the Parquet national financier) has entered into 13 French-style deferred prosecution agreements. In this session, Karen Coppens will:
1. Provide an overview of the key provisions of the Sapin II law, how the French-style deferred prosecution agreement works, explain the similarities and differences with the tools available in the US and UK.
2. Provide an overview of the proposed reforms (Sapin III) and the impact they will have on companies and their employees.
3. Provide practical advice on how to handle multi-jurisdictional investigations and pitfalls to avoid.
4. Provide an overview of the French particularities that need to be taken into account when conducting an investigation (French blocking statute, professional secrecy, labor law, data protection rules).
Part 3 – Third Party Risk
Based on his experiences as former lawyer, ex-head of ethics and as Executive Compliance Officer at Clifford Chance, Antoine Labaune will help you understand third party risks and keys to mitigate the exposure: internally and externally.
